We issued marriage licenses & explained the ceremony had to be performed by a licensed minister or a justice of the peace in our county. We had a few instances where the ceremony was performed by individuals such as a notary public or attorney & we advised the couple their marriage was invalid. This was 7 years ago in a small county in NC. With so many differing laws and statutes, and the responsibility lying with each state, it’s confusing for the general public. Bring religious belief systems and the law together…they’re not happy bedfellows. It’s time for our country to somehow have one set of laws pertaining to marriage. Just like the fiasco that took place in California a while back where marriages were deemed invalid for homosexual couples, the same circumstances are in place for that to happen to countless Americans. Until something is done federally, couples should verify they are having their ceremony performed by whomever is legally permitted in their state. However, if you live near the state border you might consider going to your neighboring state if their laws allow the ceremony to be performed differently & correspond with your wishes. It requires some homework for sure – usually more than most people anticipate. Currently, it’s similar to TV commercials for fast food establishments: the sandwich is selling for a certain price on the commercial, but your local restaurant might not participate in that campaign. These days, not only does the marriage itself take work, you must jump through many hoops & loops before the knot is firmly tied.

They just need to decide on some generic terms of Civil Union to apply to property, taxes and the like…things government related, and leave the rest alone.
